This is a legal document regarding renting the Eplex Sports Academy. You are required to agree to its terms and conditions before you proceed to use the Eplex Sports Academy. It affects your rights – please read it carefully.
Terms
The “Eplex Sports Academy” refers to the studio located at 6940 Beach Blvd. Buena Park CA 90621, and includes the equipment and facilities located within it.
The “Leasee” refers to the person who is renting the Eplex Sports Academy.
The “Activity” refers to participation in any personal or group fitness activity and general advices.
The “Participant(s)” refers to the individual(s) present in the Eplex Sports Academy studio participating in any activity during the rental period engaged by the Leasee.
Release and Indemnification
By agreeing to the Release and Indemnity I confirm that I and any other participants present in the studio with me are suitably fit and healthy to participate in exercise or physical activity and that a doctor or allied health professional has not advised me or my participants otherwise. I take full responsibility for my own and my participants’ safety and welfare while I and/or my participants are using the Eplex Sports Academy.
I acknowledge that it is a condition of renting the Eplex Sports Academy that I do so at my own risk and care. I will assume full responsibility for my own safety and welfare as well as those of my participants who will be in the studio with me.
I accept all risks and hereby indemnify and release Eplex Sports Academy, their agents, affiliates, employees, members, sponsors, promoters and any person or body directly or indirectly associated with Eplex Sports Academy, against all liability (including liability for their negligence and the negligence of others) claims, demands, and proceedings arising out of or connected with my lease and use of the studio.
This release and indemnity continues forever and binds my heirs, successors, executors, personal representatives and assigns.
I acknowledge that participation in this activity may involve risk of serious injury or even death from various causes including over exertion, dehydration, equipment failure, and accidents with equipment and surroundings.
I recognize the difficulties associated with the activity and attest that I and my participant(s) are physically fit to participate safely in the activity and that a qualified medical practitioner has not advised me and my participant(s) otherwise.
I understand the demanding physical nature of the activity. I am not aware of any medical condition, injury or impairment that will be detrimental to my health or the health of my participant(s) if we participate in this activity. By continuing to participate in this activity I accept the risks despite these conditions and am still, and will always, be under the terms of this agreement.
